Legislative Decree N° 196 of 30th June 2003 - (Law for the protection of personal information)

Persuant to and in accordance with article 13 of the above-mentioned law, WE ADVISE that PROMOHOTELS SRL uses the personal information of clients, suppliers and parties that have voluntarily communicated, directly or by telephone, via fax or post or e-mail, their personal information to our commercial offices and to the company responsible for our telemarketing.

Persuant to and in accordance with this law (rer. Art. 2 – Aims), PROMOHOTELS SRL guarantees that the personal information will be treated respecting fundamental rights and freedoms, as well as the dignity of the person in question, with particular reference to confidentiality, personal identity and the right to the protection of personal information.

Aims of using the personal information

All the information given by the interested parties is used exclusively for the company’s economic activities and, in particular:
* to enter the information into the company’s IT databases;
* to process internal statistics;
* to register technical reports for assistance and training;
* to issue transport documents, invoices and credit notes;
* to issue estimates and offers to active and/or potential clients;
* to issue requests for estimates and offers to active and/or potential suppliers;
* for ordinary and extraordinary accounting and VAT;
* for managing monies received and payments;
* to send commercial information regarding our activities or those of companies linked to the IT sector, to active and/or potential clients;
* to exchange internal information regarding out economic, administrative and commercial activities – via telephone, post, forwarders, fax, e-mail and through private areas of the PROMOHOTELS SRL Internet site:
* to satisfy the obligations as laid down by the law, by regulations, by EC rules and by civil and fiscal regulations;

Communication and circulation of the information

The personal information of the persons in question can, if necessary, also be conveyed to:
* all those parties whose access to the information is recognised under the regulations;
* to our collaborators, employees, agents and suppliers, with jobs and/or eventual contractual obligations with them, regarding commercial involvement with them;
* to companies dealing with factoring, credit recovery and credit insurance;
* to companies that produce and/or grant licenses for eventual services provided, only when the communication is necessary for use by the party interested in the services/products purchased;
* to post offices, forwarders and couriers for sending documentation and/or material;
* to the suppliers of Unified Messaging services via Internet, for sending letters and messages to the interested parties regarding the aims of the use of the information when using this channel;
* to all persons and/or legal persons, public and/or private (legal, administrative and fiscal consultants, labour consultants for the compilation of wage packets, Judicial Offices, Chambers of Commerce, Labour Offices etc.) when the message is necessary or functional for our activities and in the ways and for the aims as illustrated above;
* to banks for handling monies received and payments arising from contracts.

How the information is collected and the consequences of an eventual non-assignment
Parties who intend working with our company understand that by agreeing to provide their personal information, which is purely informative and regarding our activities/services, is optional, but should they not agree there could be a termination in the rapport, in performing it correctly and the eventual legal, and even fiscal fulfilment. The information is kept in the operative headquarters of our company for the time prescribed by the civil and fiscal laws.


How the information is used The personal information is used exclusively inside the headquarters of PROMOHOTELS SRL using both paper and IT and via telephones and IT supports as well as automated tools, that memorize, manage and transmit the information, observing all cautionary measures that guarantee the security and confidentiality of the same.

Right to access the personal information
The interested party has the right to obtain confirmation of the existence or non-existence of his or her personal information, even if these have not yet been registered, and receive them in an intelligible form

The interested party has the right to obtain information regarding:
* the origin of the personal data, the aims and the ways it is used; The rationale applied in the case the information is processed using IT tools;
* information regarding the holder and the person designated to represent pursuant to and in accordance with article 5, paragraph 2 of Law 196/2003;
* the parties and categories of parties to whom the personal information can be given or who can come into possession of said information in their role of designated representatives in Italy, persons in charge or nominated;

The interested party has the right to have:
* the updating, the rectification or, if he or she so desires, the integration of the information;
* the cancellation, the transformation into an anonymous form or the blocking of the information used in violation of the law, including when it is not necessary to keep the information in relation to the aims for which it was collected and subsequently used;

The interested part has the right to oppose, entirely or partially:
* for legitimate reasons the use of the personal information, even though still pertinent to the aims of the collection;
* to the treatment of his/her personal information with regard to sending advertising material or direct sales or to carrying out market research or for commercial messages.

The above rights can be carried out by asking the holder or one of the persons responsible, also through an appointee, to which a timely reply is provided. The request to the holder or to the person responsible can also be sent by registered post, fax, e-mail. . Art. 7
(Rights of access to personal information and other rights)

1. The interested party has the right to obtain confirmation of the existence or non-existence of his/her personal information, even if it has not yet been registered and they are intelligible.

2. The interested party had the right of obtain information regarding:
a) the origins of the personal information;
b) the aims and means of using the personal information;
c) the rationale applied in the case of a use involving IT tools;
d) the identity of the holder, the persons responsible and the person designated as representative as in article 5, paragraph 2;
e) the parties or the categories of parties to whom the personal information can be given or who can come into possession of said information in their role of designated representatives in Italy, persons in charge or nominated;

3. The interested party has the right to obtain :
a) the updating, the rectification or, if he or she so desires, the integration of the information;
b) the cancellation, the transformation into an anonymous form or the blocking of the information used in violation of the law, including when it is not necessary to keep the information in relations to the aims for which it was collected and subsequently used;
c) proof that the operations as described in a) and b) have been communicated, also with regard to their content, to those persons to whom the information has been given or communicated, except in the case in which this is impossible or calls for the use of means that are manifestly out of proportion to the right being safeguarded.

4. The interested party has the right to oppose, entirely or in part:
a) for legitimate reasons the use of the personal information, even though still pertinent to the aims of the collection;
b) to the treatment of his/her personal information with regard to sending advertising material or direct sales or to carrying out market research or for commercial messages.

THE SITE’S SECURITY MEASURES

Specific security measures have been adopted, aimed at guaranteeing secure access and protecting the information in the reserved area from the risks of loss or even accidental destruction, of un-authorized access or use that has not been granted or is not in compliance with the aims of the collection.
The software antivirus is updated automatically. In order to access the site’s reserved area PIN codes and passwords are assigned. These codes and passwords are assigned and sent confidentially to the person designated by the client, if a company or organization, or else to the client himself or herself.
The user is bound to keep the PIN code and password confidential.
